Invoice: PMI Cease & Desist Letter Service Package

Situation. After collaborative discussions and confidential information sharing with the PMO Global Institute (“PMOGI”) leadership concerning potential collaboration, the Project Management Institute (“PMI”) suddenly and without warning or explanation issued a written order to its chapter presidents to cease communications with and reject requests for collaboration with PMO, citing confusion with and detraction from the products, programs, and services offered by PMI.

PMI’s action has damaged PMOGI’s reputation, caused PMOGI members to withdraw, caused prospective PMOGI members to refrain from joining the PMOGI, and created confusion and doubt among the project management community worldwide. PMOGI must now take affirmative actions to mitigate the effects of PMI’s actions and minimize the future impact of those actions on its credibility and viability.

General Counsel Online proposes to take the following actions to assist PMOGI in its efforts to respond to PMI’s actions:

1. Review and Investigate. GCO will review all communication and supporting documentation necessary for its support of PMOGI. Estimate: 1 hour.
2. Demand Letter. GCO will send a demand letter to PMOGI. The letter will state the grounds for PMOGI’s objection to PMI’s actions and allege the damages that PMI’s communications have caused. It will also demand that PMI cease current communications, prescind from any similar future communication, withdraw and apologize for statements already made, and pay restitution for the damages it has already caused. GCO will share a draft of the demand letter with PMOGI and, on the basis of its comments, craft a final letter for sending to PMI. Estimate: 3 hours.
3. Response. GCO will be on standby for a PMI response, including conference calls between PMI management and PMOGI management and/or communications directly with PMOGI management and/or attorneys. Estimate: 1 hour.
4. Transition. Should PMOGI decide to initiate litigation against PMI, GCO will help identify and secure a litigation attorney and aid in the transition of the matter from GCO to the litigation attorney. Based on what we have learned so far, there are several potential claims PMOGI might pursue against PMI: trade liable, tortious interference with contract, interference with prospective economic activity, actions in restraint of trade, Estimate: 1 hour.

GCO works on a fixed-price basis with its clients and takes the risk that the actual hours expended will exceed the price quoted. We estimate that the above activities will take 8 hours in total. Our standard billing rate is $300 per hour. We, therefore, offer to perform the above services for a total of $1800, regardless of how much time it actually takes to perform the work.

This engagement is governed by the terms of the GCO agreement with your company.  The fee is refundable upon your request until the services are rendered, less payment processing fees, which are on average about 3% of the purchase price. If services have been partially rendered, you are entitled to a reasonable partial refund.   Refunds will be credited to the credit card that you used to purchase the services.
